A case of perjury may be preferred against one Destiny Enabulele, a former council chairman, Ovia South West who reportedly confessed before the Edo State Election Petition Tribunal sitting in Benin city that his statement on oath was an error.
Enabulele, who was PW4, from Ovia South West for the petitioners (PDP, Asue Ighodalo) committed a criminal offense punishable under the Nigerian criminal code, when he told the tribunal that his statement on oath were fought with errors.
Section 118 of the Nigerian Criminal Code stated that persons like Enabulele, who has by himself confessed to this offense could be punished for up to 14 years imprisonment.
While he has by himself dismantled his credibility and that of the petitioners, the Peoples Democratic Party (PDP) and its candidate, Asue Ighodalo, it is doubtful if the tribunal would rely on his evidence.
“This witness has not only done irreparable damage to the petitioners’ case, he has succeeded in letting the world know that the integrity of the entire case should be called to question,” a legal practitioner, who crashed anonymity said.
“If Destiny Enabulele is their best foot forward – I mean, a star witness, it is safe to say that the petitioner is stumbling and his case crashing.”
