Osinachi | Court Fixes Date to Rule on Husband, Nwachukwu’s No Case Submission | METROWATCH

Federal Capital Territory, FCT, High Court, Wuse 2, has fixed October 17 to rule on the application filed by Peter Nwachukwu, husband of the late gospel singer, Osinachi Nwachukwu.

Osinachi died on April 8, 2022, over alleged maltreatment and domestic violence from her husband.

Following public outcry, the Nigeria Police Force arrested Nwachukwu and handed his case file to the Office of the Attorney General of the Federation for prosecution.

Trial commenced on June 20, 2022, with the prosecution calling 17 witnesses to give evidence. It eventually closed its case on March 10, 2023.

When arraigned before Justice Njideka K. Nwosu-Iheme, Nwachukwu pleaded not guilty to the 23-count charges bordering on domestic violence and homicide.

He was subsequently remanded at the Kuje Correctional facility.

A report by the police said no mark of violence was noticed on the deceased and listed the causes of her death to include “generalized organ pallor, bilateral leg swelling, fluid in the sac containing the heart. Tumor deposits in and on the heart, lungs, kidneys. Massively enlarged heart and fluid around the lungs which restrict breathing.”

To this end, Nwachukwu’s lawyer, A. Aliyu, had filed a no case submission.

Aliyu informed the court that the evidence of medical practitioners presented by the prosecution completely exonerated Nwachukwu of culpable homicide.

During Tuesday’s resumed hearing, Justice Nwosu-Iheme fixed October 17 to rule on the no case submission application filed by Nwachukwu.
